Prohibited Discrimination/Title VI and Title VII
FDU is committed to having a community where all members are respected and belong. This includes the fostering of a community where everyone is free from any form of discrimination based on a protected status. FDU does not tolerate discrimination, misconduct, or harassment of any kind.
Included in FDU’s prohibition of all forms of discrimination are the protected classes specifically protected by the Civil Rights Act of 1962, more specifically, Titles VI and VII.
Title VI
Title VI and its regulations require that colleges and universities receiving federal financial assistance provide all students with a school environment free from discrimination, or harassment, based on race, color, or national origin. This right extends to discrimination or harassment based on shared ancestry or perceived shared ancestry or ethnic characteristics or citizenship or residency in a country with a dominant religion or distinct religious identity. This means that students have a right to be free from ethnic or racial slurs, harassment for how they dress or speak, and from any stereotypes based on actual or perceived shared ancestral or ethnic characteristics.
Title VI also prohibits educational institutions from treating students differently because of their actual or perceived national origin absent a legitimate, nondiscriminatory reason for denying or limiting a student’s ability to participate in an educational program or activity.
Title VII
Title VII protects individuals from employment discrimination. Title VII protects employees and applicants for employment, from discrimination on the basis of race, color, religion, sex (including pregnancy, sexual orientation, and gender identity) or national origin discrimination. This includes discrimination based upon a person’s actual or perceived race, color, religion, sex color or national origin.
Title VII prohibits employment discrimination against any individual with respect to their compensation, terms, conditions, or privileges of employment,
Title VII also prohibits discriminatory harassment in the workplace based on race, color, religion, sex (including pregnancy, sexual orientation, and gender identity), and national origin. Harassment becomes unlawful if it changes an employee’s employment conditions or creates a hostile work environment.
Statuses Protected Under FDU’s Non-Title IX Prohibited Discrimination, Harassment and Related Misconduct Policy
In addition to those listed above, under its Non-Title IX Prohibited Discrimination, Harassment and Related Misconduct Policy, FDU prohibits discrimination based on all of the following protected statuses in the United States: age, color, creed, disability, gender, gender expression, gender identity, genetic information, national origin, race, religion, sex, sexual orientation, and veteran status. In addition to the above, for Canada, the following statuses/characteristics are included: ancestry, family status, indigenous identity, marital status, mental disability, physical disability, and political belief.
